at the Clarke Co. Fairgrounds 2070 W Mclane St, Osceola, IA

4 excellent seperate tracts 6 miles SE of Osceola. Great mix of pasture and recreational land. Excellent hunting opportunties with mature timber.

Tract 1 – 278 acres m/l

278 acres, m/l with open pasture, timber and a 40โ€™x 80โ€™ open front building that was built in 1980. There is approximately 80 acres of timber and other patches of cedar trees. There is a pond just NW of the building and a creek flowing through the property. There is a pond N of the building with two ponds near the SW end, and a creek flowing through the property. There are two gates on the W road and one ย in the SW corner of the level B road. The north portion has a regular gravel road but the south portion is level B. This is a good pasture and is a great recreational site with excellent deer and turkey hunting.

The south property line will need to be fenced if this parcel is sold separately from Tract 3. There is an access easement starting at the west road entrance and leading to the adjoining landowners 20 acres to the east. See dashed line on the map. The maintenance of this easement is the responsibility of the owner of the 20 acres. The access on the west is a level B road. Murrane has 3/8 mile of left hand fencing responsibility on land adjoining the Gunderson land. The gravel is not as heavy as other roads. This is a good pasture and is a great recreational site with excellent deer and turkey hunting.

Auction Sales Method: The land will be sold in 4 separate tracts at live public auction, with online bidding available on a price per acre basis to the highest bidder. The trustees have every intention to sell the properties, but they have the right to reject any and all bids. This is a RESERVE Auction, and the final bid will be presented to the owners and their advisors to decide whether to accept the top bid.

Selling as Four Tracts: Tracts 1, 2, 3 and 4 will be offered separately starting with #1 then #2 then #3 then #4. They will not be combined at anytime so if a Buyer wants more than one tract then they need to buy them as they come available. If tracts 1, 2 and 3 sell together then these parcels will not be surveyed. If these tracts sell separately then they will each be surveyed. The multiplier for the closing will be the net acres surveyed times the top bid. Tract 4 was recently surveyed and recorded.

Online Bidding Is Available At Start of Live Auction: Register to bid at http://bid.gannonre.com/auctions. Possession: Possession will be granted upon the expiration of the pasture lease on February 28, 2025. The hunting rights are not part of the pasture lease so these rights will belong to the new owners.

Closing: Closing will be on or before September 25th, 2024, but we could accommodate a delayed closing for 1031 exchanges or other reasons if they are approved ahead of August 8th, 2024.

Earnest Money: A 10% earnest money payment is required on the day of the auction. Payments are to be made to the Belin Law Firm Trust Account. The earnest money must be paid in the form of a cashierโ€™s check, cash or wire transfer.

Farm Lease: The subject parcels are leased for grazing and haying purposes for the 2024 crop year. These leases do not allow hunting which is the right of the owners.

Contract and Title: Upon conclusion of the auction and the decision by the sellers, the highest bidder will enter into a real estate sales contract and deposit with Belin Law Firm Trust Account the required earnest money payment. The seller will provide an updated abstract at their expense. The sale is not contingent upon the Buyers financing.

Mineral Rights: All mineral rights will be conveyed to the buyer (if any).

Taxes: Real Estate taxes will be prorated to closing.

Surveys: Tract 4 has been surveyed. A survey will be conducted after the conclusion of the auction on Tracts 1, 2 & 3 if they are sold separately. If Tracts 1, 2 & 3 are sold to one buyer then there will not be a complete boundary survey. The easement will be surveyed and recorded before closing on Tract 2.

Fences: The exterior fences are assumed to be the โ€œright hand ruleโ€ but this is not guaranteed nor the adequacy of the fences. Any divisions of tracts 1, 2 & 3 will have survey lines that buyers may have to maintain or build new fence on the right had rule between them and the adjoining property. Iowa Fencing Law will be the agreed authority source.

Other: The sale is subject to all easements, covenants, and restrictions of record. The property is sold โ€œas is – where isโ€ basis with no warranties expressed or implied by the Sellers or Gannon Real Estate & Consulting. Bidding increments are at the sole discretion of Gannon Real Estate & Consulting. Gannon Real Estate & Consulting only represents the Seller.
